A MATTER OF NATURAL
JUSTICE

To all my friends and those who might read
this Website -- I am seeking your help in order to expose a matter of Natural
Justice.
I am asking: Is there anyone out there --
whether they be members of Parliament and Authorities -- someone with "clout" in
Australia or overseas to help us?
I have placed this matter (see below) joined
with that of my Parents-in-Law -- to the Press; to all members of the House of
Representatives in the NSW Parliament, with no success.
It is not my Case that concerns me, but the
injustice towards my Sister-in-Law.

GROSS INJUSTICE
I wish to present to the Public a matter of
Natural Justice.
The matter has been given to the Members of the
Legislative Council of New South Wales and to various Government Departments --
with no positive results.
However, the Shadow Minister and the Shadow
Attorney General -- Most Honourable Mr. Tink, has tried to help us, but was also
unsuccessful.
Something should be done to rectify this
shameful exhibition of the Justice System in Australia.
Please see the enclosed material. The Names
have been omitted for legal reasons.
The matter has been placed before Prime
Minister Howard and Premier Carr.

There is no capacity for members of the public to verbally address the House;
only elected members of parliament are able to do so.
Nevertheless it is your democratic right to contact any member of the House and
contact details are available at http://www.parliament.nsw.gov.au/ (Members of
Parliament).
You may also choose to the House. At the same website go to Legislative Council
then at the bottom of the column on the left hand side you will find
publications. If you go to this you will find a fact sheet entitled "Petitions"
in which you will find information about the petition process as well as a form
which can be used.

TO THE HONOURABLE THE PRESIDENT AND MEMBERS OF THE LEGISLATIVE
COUNCIL OF NEW SOUTH WALES
THE PETITION OF CERTAIN:
Mr. William Kamm (Australian Citizen of NSW) in residence at 161B Koloona Drive
CAMBEWARRA, NSW 2540; and [Name Withheld] (residents of Cambewarra, NSW near
Nowra)
STATE THAT:
I wish to draw your attention to a matter of grave concerns -- of a case of
Natural Justice, concerning the head of the D.P.P. of NSW -- Mr. Cowdrey. He was
appointed by Mr. Carr's Government but is a public disgrace to the Justice
System.
I have approached my Lawyers to do something -- but could only get them to write
to the Shadow Minister, Mr. Tink. He expressed to them and to me that the
Liberal Party have repeatedly asked the Labour Party in Government to keep a
check or watchdog on the D.P.P. as they have autonomous discretionary powers.
Please read my letter to the House of Parliament so that this injustice is no
longer tolerated by Members of Parliament -- who represent the People of NSW.
Your consideration would be appreciated. The body of my Petition follows:
It concerns two Court Cases. One case concerns myself (Mr. William Kamm). The
other case concerns Miss [Name Withheld]. The letter below is from the parents
of Miss [Name Withheld]. The original documents (signed) can be sent to you if
you feel you can help the [Name Withheld] family as well as myself. The volume
of information is too much to send via email. Nevertheless, I have provided
here, the important letter from Mr. and Mrs. [Name Withheld] for you to read. It
will explain the situation and my statement.

TO: The Honourable President and Members of the Legislative Council of NSW.
Dear Mr. President and Members,
Firstly, we wish to congratulate you on your work as the Legislative Council. We
think this Council stands for truth and justice and believe you, Mr. President
and Members -- being in the public arena -- could help our plight. We would
appreciate your consideration, please, or at least some direction as to whom we
can turn, as all other avenues have been exhausted.
There are two interconnecting matters: one Case concerns our daughter, [Name
Withheld], and the second Case our son-in-law, William Kamm.
The Head of the D.P.P., Mr. Cowdrey, judged both matters: the first Case should
not go ahead, yet the second Case should go ahead.
They are, however, interconnected, as Mr. Kamm is the main witness to the first
Case concerning my daughter. Regarding the second Case, being the main witness,
he was arrested in August 2002. It is not a directly related Case though, and
will be explained.
Our Main disillusionment is that Mr. Cowdrey dismissed the Case of our daughter
before it even went to Court, and neither our daughter, nor ourselves were
advised, or even spoken to by any Counsellor as to the reason why it was
dismissed.
Yet the second Case, being Mr. Kamm, was not being dismissed, even after the
Local D.P.P. supported Mr. Kamm's Lawyers for a "No-Bill", yet the D.P.P., Mr.
Cowdrey, said it was to go to trial.
We believe Mr. Cowdrey was unjustified in both Cases, and should be charged for
grave injustices and unqualified reasons for his decisions, as well as exposed
for this gross negligence.
We have presented this Case, with our son-in-law, to a Member of Parliament, Mr.
Andrew Tink, and the Attorney General -- and even our Lawyers have done the same,
without success. The Police Superintendent has been advised, but we have been
unsuccessful in exposing this unjust man, Mr. Cowdrey.
Therefore, though very reluctant to expose these details, we believe you might
be able to help Mr. Kamm and our family -- especially to the benefit of Mr.
Kamm's own Case.
Please consider our desire to send you more information. Then you can read all
the material related to these Cases and you will see for yourself the injustices
that occurred. Case No. 1: [Name Withheld] -- our daughter, who is now 18 years -
was sexually abused, repeatedly, by a Mr. [Name Withheld]. Our daughter was only
7 or 8 years old at the time.
We lived in a Community of fellow Christian members of about 150 people. We came
from Germany in 1991, when our eldest daughter married Mr. Kamm.
Living within the same Community was a family by the name of [Name Withheld]. It
was their son, [Name Withheld], aged 19, who began molesting our daughter, [Name
Withheld]. She was very close to our son-in-law at the time and often stayed in
his home with her sister, who was married to him. [Name Withheld] spoke to Mr.
Kamm about what had been transpiring between [Name Withheld] and her.
Mr. Kamm, who is the Founder of the Religious Order and Moderator of this
Community, advised my wife, [Name Withheld], about the matter first, and then
approached [Name Withheld] in the presence of a witness -- a Priest of the Order.
[Name Withheld] admitted he was sexually active with the child.
This was not taken to the Police at that time as my family were proceeding with
Australian Residency, and we were caught up in Legal battles. Later, the matter
was brought to the attention of [Name Withheld].
In 1998, the [Name Withheld] family left the Community to live nearby. They,
themselves had a dispute with Mr. Kamm regarding settlement of their home.
In 2002, one of their daughters, [Name Withheld], charged Mr. Kamm with a sexual
offence, together with one of my own daughters, [Name Withheld]. The charges
were very mediocre compared with those of [Name Withheld]. This, then triggered
off my daughter's desire to charge [Name Withheld] for his crime against her.
Originally the Police did not want to proceed in charging [Name Withheld] for
sexually assaulting our daughter, as they could see Mr. Kamm was the main
witness. The matter was given to the Police on 21st August, 2002.
On 21st November, 2002, the Police advised that this matter was not going to
proceed to investigate the negligence of the Detective. My Lawyers then began a
process of Civil Action against [Name Withheld], which started on 20th January,
2003 -- 5 months later. The matter was dismissed by the D.P.P. on 22nd May, 2003.
The matter was brought to the attention of the Ombudsman, and a reply was given
in November, 2003. On 7th January, 2004, the D.P.P., Mr. Cowdrey, advised our
Lawyers that the Case was dismissed, and it was not necessary to advise the
victim or the parents, as it was the role of the Lawyers.
As for Mr. Kamm's Case: Last year a "No Bill" was offered to the D.P.P. from his
Lawyers, with the support of the D.P.P. in Wollongong. The D.P.P. of Wollongong
agreed with Mr. Kamm's Lawyers that Mr. Kamm was innocent of the charges, and
the Case should be dismissed. This was in June last year. The Head of the D.P.P.,
Mr. Cowdrey, dismissed the "No Bill" and said it would go to Trial.
Mr. Kamm's Case involves my daughter, [Name Withheld], and [Name Withheld]
sister, [Name Withheld]. They claim Mr. Kamm sexually assaulted the two girls
when they were 15.
In this Committal Trial, which was highly publicized, it was proved that this
was not the Case. Mr. Kamm's life was threatened, yet no Police action. The two
girls committed perjury 21 times, admitting it in Court that it was a set-up by
the Police, Media and boyfriend of our daughter. They blackmailed Mr. Kamm and
tried to extort a large amount of money from him, with threats -- yet the Police
did nothing, and would not charge them.
The Media prepared a "Today Tonight" Show -- this was even before the arrest --
with the collaboration of the Police. Police Statements were changed, and even
the Court Transcripts were changed. All of this -- and still Mr. Kamm's Case
proceeds to Trial.
Mr. Kamm requested help for our daughter's Case, and his own Case through
members of Parliament, even asking help from the Judicial Commission, but to no
avail.
That is the situation as it stands.
We believe that our daughter and Mr. Kamm have been treated with gross neglect
in natural justice. Because of the Bureaucracy of the Justice System where men
like Mr. Cowdrey have the authority to wield their power -- with no one checking
on what they do.
I ask, Mr. President and Members of the Legislative Council, that you help us,
please, so true justice is served.
