Mr. W. Kamm
The Editor, Dear Sir, Once again I wish to address the matter of false representation by your paper! In today’s paper, the heading reads: ‘Kamm defiant: I’m not guilty’ It is clearly seen that you are trying to get across to the public that I am defiant, in spite of the Magistrate’s ruling. You have claimed that: "Magistrate O’Connor ruled the evidence was capable of convincing a jury beyond reasonable doubt of Kamm’s guilt." In other words, Kamm does not accept the Court’s ruling, as you have erroneously reported. The fact is the Magistrate did not rule, as you claimed, but claimed that there was enough evidence to make a "Prima Facie" Case – (on the face of it) – but he is yet to determine whether there was sufficient evidence for a jury to be likely to convict him. Then Glenn Ellard reported a letter that was submitted to Court from [...name withheld...] – the mother of one of the girls – yet omitted to report the evidence that my Barrister placed before Court. Then we come to the heading: ‘Threats from defacto mar proceedings’ You tried to portray to the public the defacto was giving these threats because his defacto was shouting out in court: "He raped me at 14!" The truth is, this fellow was a loose cannon, and the Prosecutor was well aware of his character, not wanting him in Court. It had nothing to do with what was said by his defacto, as this person had threatened me last year. This, also was reported in the paper, but put in such a way as to present it in a different light. It is clear to me, as it is to many in the public arena, that the media are becoming "Judge and Jury" with their distortion of the truth. Your paper, as has many others, repeats the charges over and over again, in detail, to make sure the public are constantly reminded – yet you are not willing to state the facts and the truth. Once again you wrote that Mr. Kamm said: "I am not guilty, and I reserve my defence." Then you go on to say: "However, Magistrate O’Connor ruled the evidence was capable of convincing a jury beyond reasonable doubt of Kamm’s guilt." You know very well this is not what the Magistrate stated! It is clearly seen this is trial by Media! You might be interested to know that the Illawarra Mercury reported it correctly in the Saturday edition. Yours truly, [signature] William Kamm |
